·       A drug can be called as a spurious if

o   It is imported under the name which belongs to another drug

o   It is a substitute for another drug

o   Its label or container bears the name of another drug

o   It is having the name of the company that does not exist

o   It purports to be the product of a manufacturer of whom it is not truly a product

·       Luk for Lux

·       Saveena for Sabeena

·       Sun max for Super master

·       Relax for Rolex

·       Ribok for Reebok

 

Incidents

·       Rs 2.5 crore worth spurious drugs seized by FDA (Mumbai)

·       Famous brands such as

o   Loreal

o   Lakme

o   Nivea

o   Eile 18 etc were manufactured with low quality

 

Reasons for the Manufacturing of Spurious Drugs

·       Profit

·       Length supply chain

·       Huge gap in demand and supply

·       Low cost to the customer

·       Affordability

 

Measures to Counter Spurious Drugs

·       Putting up 3-d holograms on the products

·       Printing bar codes across the products

·       Law on the piracy & copying

·       Frequent raids by the police on all the illegal activities

·       More promotion campaigns that lay emphasis on genuine products

 

Offences & Penalties

·       Manufacturing for

o   Sales

o   Distribution

o   & stocking of spurious drugs can results in 3yrs imprisonment and Rs 50,000 fine

·       Non disclosure of name of manufacturer or place where manufactured drugs are kept

o   One year imprisonment & Rs 10,000 fine

·       Not keeping the records of manufacture and sale of cosmetics in specified manner

o   3yrs imprisonment and Rs 50,000 fine
